I have always thought that the Law is only a guideline that we establish to have a starting point for Justice. Ultimately, most Americans expect Justice, not the Law, to rule the day, er...Courtroom. Thomas Jefferson said that Law is usually the rule of the tyrant, right is the determination of the people, which is why we have Juries of our peers.
Recently I was interviewed by a Poly-Sci minor going for the Attorney gold. She informed me that she would never vote for me because my ideas were not conducive to her future proffesion. My ideas, you may recall, try to promote Justice over Law, simplify Laws so that every person can understand them and have a reasonable chance at defending themselves, and never voting Attorneys to Political Office. Nothing here that a Moral, Ethical, Freedom loving American would have a problem with...unless your bread and butter is in abusing the system for your personal gain, Justice be damned. Now I am not trying to say this young student is a bad person, only out for personal gain, but that is the new definition of "Opportunity" in America. Get what YOU can at anyone's expense because you deserve it and THEY are to blame for being so gullible. Everything in America is broken for the same reason, Greed, self gain at all costs!
Courts are not about Justice they are about profit, "Need a pay raise next year Officer, then go write more tickets". Courts used to be paid from our taxes, then came $50 dollar "Court Costs", now we pay several hundred dollars for a a Class C Misdemeanor Traffic Ticket. If it is getting so expensive to hold court, maybe they shouldn't be in these big, extravagant buildings, if trailers are good enough for our schoolchildren, they're good enough for our Public Servants. If we want Justice back in our Legal System, remove the incentive to abuse it, remove money from the equation. We start giving Community Service instead of fines, no Court Costs, cheaper facilities, and make it so the People can once again defend themselves. Heck, think how much we'll save on the reduction of continuances, alone.
The major problem with Attorneys today, is Precedence. In the modern world, an Attorneys job is to change the perceptions of the Jury to excuse the actions of their client. Misconstruing or redefining Law as it is necessary, e.g., using the Constitution to procure rights for Illegal Immigrants. In this example, the preface of the Constitution clearly states who is covered by it, in short, ONLY LEGAL CITIZENS of the United States, it doesn't cover certain Felons or Native Americans that keep to their heritage, ergo, it never covers Illegal Immigrants. However, certain Attorneys have actually gotten courts to accept that they are covered and forced good citizens to acquiesce to the demands of the Illegal over both the Will of the People and their rights. No matter what side of the fence you choose in this issue, placing non-citizens above the citizen is a dangerous way to handle the Law and the Constitution. But, this is the Modern American Attorney, don't stand in the way of "progress", even if it is self-destructive.
Attorneys should be relegated to contracts, defending guilty people, divorces, and implementing necessary change through reasonable Civil actions. An innocent should never have to hire one, a court should never demand one, and the Constitution and our Laws should never be misconstrued by one.
